Welcome to GymScribe. These Terms & Conditions govern your access to and use of the GymScribe mobile application, website, and related services (collectively, the "Service").
By registering for an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Description of Service
GymScribe is a business-to-business (B2B) software platform designed to help gym owners and managers track memberships, manage payments, and send automated notifications (such as invoices and reminders) to their gym members.

Account Registration & Security
To use GymScribe, you must register for an account. You agree to provide accurate, complete, and current information during registration.
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.

WhatsApp Notifications & Member Consent
GymScribe utilizes the WhatsApp Business API (WABA) to send automated notifications and invoices to your gym members on your behalf. By using this feature, you agree to the following strict communication rules:
Mandatory Opt-In: You represent and warrant that you have obtained explicit, verifiable consent (opt-in) from every gym member before adding their phone number to GymScribe to receive automated WhatsApp or SMS messages.
- You are solely responsible for compliance with local telemarketing and anti-spam laws.
- GymScribe is not liable for any penalties, account suspensions, or legal action resulting from your failure to obtain proper consent.
- If GymScribe receives spam complaints regarding your account, we reserve the right to suspend or terminate your messaging capabilities immediately.

Subscriptions and Payments
GymScribe is a subscription-based service. Subscription fees are billed on a recurring basis (monthly or annually) as selected during registration.
- All payments are securely processed via Razorpay.
- Fees are non-refundable, except where required by law.
- We reserve the right to change our pricing. We will provide at least 30 days' notice before any price changes take effect.
- Failure to pay subscription fees may result in the suspension or termination of your access to the Service.

Data Ownership & Privacy
You retain all rights to the member data you input into GymScribe. GymScribe acts as a data processor. We will only use your data to provide the Service as outlined in our Privacy Policy. We do not sell or share your member data with third parties for marketing purposes.

Limitation of Liability
GymScribe is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GymScribe and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use or inability to use the Service.

Termination
You may cancel your subscription at any time. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms (including failing to secure member consent for WhatsApp messages) or engage in fraudulent or illegal activities.

Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Telangana, India.
